 OmniPsych LLC ("OmniPsych," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit omnipsych.org and any webpage that links to this Policy (collectively, the "Website"), contact us, schedule a consultation, subscribe to communications, or interact with our Website's live artificial intelligence chatbot. It also explains choices and rights that may be available to you.


Please read this Policy carefully. By using the Website, you acknowledge the practices described below. If you do not agree with this Policy, please do not use the Website or submit personal information through it.

Scope of This Privacy Policy

This Policy applies to personal information collected through the Website and related communications with OmniPsych. It does not govern information that OmniPsych processes on behalf of consulting clients under separate agreements, information collected through a client's systems, employee or contractor records maintained outside the Website, or third-party websites and services that maintain their own privacy policies.


The Website is intended for individuals located in the United States. It is not directed to individuals outside the United States, and OmniPsych does not market the Website to them.

Personal Information We Collect

 The personal information we collect depends on how you interact with the Website.


Information You Provide

  • Contact and inquiry information, such as your name, email address, telephone number, company or organization name, and the contents of your message.
  • Consultation scheduling information, such as your preferred appointment date and time, contact details, organization information, reason for the consultation, and other information you choose to provide when scheduling.
  • Newsletter information, such as your name, email address, subscription preferences, and records showing when you subscribed, opened a message, clicked a link, or unsubscribed, to the extent those features are supported by our email service provider.
  • Chatbot information, including the questions, prompts, messages, and other content you enter into the live AI chatbot, along with information needed to maintain the chat session.
  • Communications and request records, including emails, telephone communications, privacy requests, feedback, and any related correspondence.

 

Information Collected Automatically

When you visit the Website, we and service providers supporting the Website may automatically collect limited technical and usage information, including:

  • Internet Protocol (IP) address and approximate location derived from the IP address;
  • Browser type, device type, operating system, language, and device identifiers;
  • Pages viewed, links clicked, referring and exit pages, visit dates and times, session duration, and other Website activity;
  • Cookie identifiers, analytics identifiers, and similar technical data; and
  • Security, diagnostic, performance, and error-log information.


Information from Other Sources

We may receive information from service providers that support Website hosting, scheduling, email delivery, analytics, cybersecurity, or chatbot functionality. We may also receive business contact information from publicly available sources or referrals when permitted by law.

How We Use Personal Information

 We may use personal information to:


  • Operate, maintain, secure, troubleshoot, and improve the Website and its features;
  • Respond to inquiries and communicate with you about OmniPsych's behavioral health consulting services;
  • Schedule, confirm, conduct, and follow up on consultations;
  • Send newsletters and other communications you requested, and manage subscription preferences;
  • Provide and improve the live AI chatbot and respond to chatbot interactions;
  • Understand Website use, measure performance, and evaluate the effectiveness of content and outreach;
  • Protect the rights, safety, property, and security of OmniPsych, Website users, clients, and others;
  • Detect, prevent, investigate, and address fraud, misuse, security incidents, or unlawful conduct;
  • Comply with applicable laws, regulations, legal processes, professional obligations, and enforceable governmental requests;
  • Establish, exercise, or defend legal claims and enforce our agreements and policies; and
  • Carry out another purpose disclosed at the time information is collected or with your consent.

Cookies, Analytics, and Similar Technologies

 The Website and its hosting platform may use cookies, pixels, local storage, log files, and similar technologies. Some technologies are necessary for Website operation, security, network management, and user preferences. We may also use analytics tools made available through Google, GoDaddy or other service providers to understand traffic and Website performance.


You can usually control cookies through your browser settings. Blocking or deleting cookies may affect certain Website features. At present, OmniPsych does not use personal information for cross-context behavioral advertising and does not sell or share personal information for advertising. We honor legally required opt-out preference signals, such as Global Privacy Control, when and to the extent applicable. Because browser-based 'Do Not Track' signals are not governed by a uniform standard, the Website may not respond to them unless required by law

Live Chat AI Bot

 The Website includes a live chatbot that uses artificial intelligence to provide general information and help route inquiries. The chatbot may generate automated responses that are incomplete, inaccurate, or not appropriate for a particular situation. Chatbot responses are for general informational purposes and do not constitute clinical, medical, legal, compliance, human-resources, or other professional advice.


Messages entered into the chatbot may be transmitted to and processed by a third-party technology provider acting on our behalf. Do not enter patient information, protected health information, medical records, Social Security numbers, financial account information, passwords, trade secrets, or other sensitive or confidential information into the chatbot. OmniPsych may review chatbot conversations for quality assurance, security, support, and service improvement, subject to applicable law and our service-provider arrangements.

Consultation Scheduling and Newsletter Communications

 Consultation Scheduling

If you schedule a consultation, the information you submit may be processed by a scheduling or calendar service provider. Scheduling a consultation does not guarantee that OmniPsych will accept an engagement and does not create a consultant-client, provider-patient, fiduciary, or confidential relationship. Any consulting engagement will be governed by a separate written agreement.


Newsletters

If you subscribe to an email newsletter, we may use your contact information to send the requested communications. You can unsubscribe at any time by using the unsubscribe link in the email or contacting us at lisa@omnipsych.org. We may retain limited suppression-list information to honor your opt-out. Unsubscribing from promotional communications does not prevent us from sending non-promotional messages related to a pending request, consultation, contract, security matter, or legal obligation.

How We Disclose Personal Information

 We may disclose personal information in the following circumstances:

  • Service providers. We may provide information to vendors that perform services on our behalf, including Website hosting, domain services, scheduling, email delivery, analytics, chatbot technology, information technology, data storage, cybersecurity, and professional support. These providers may use information only as permitted by their agreements with us and applicable law.
  • Professional advisers. We may disclose information to attorneys, accountants, insurers, auditors, and other professional advisers when reasonably necessary to obtain their services or protect our interests.
  • Legal and safety purposes. We may disclose information when we reasonably believe disclosure is required by law, legal process, or governmental request, or is necessary to protect rights, safety, security, or property; investigate misconduct; or prevent fraud or harm.
  • Business transactions. If OmniPsych is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, information may be disclosed as part of evaluating or completing that transaction, subject to appropriate protections.
  • With your direction or consent. We may disclose information when you direct us to do so, consent to the disclosure, or intentionally interact with a third-party feature.


We do not sell personal information. We do not share personal information for cross-context behavioral advertising or targeted advertising. We do not disclose personal information to third parties for their own independent direct-marketing purposes.

Sensitive Information and Patient Information

 The Website is designed for general business inquiries and is not intended to collect patient information, protected health information (PHI), clinical records, treatment information, or other sensitive health information. Do not submit patient names, diagnoses, treatment histories, medical records, insurance information, or other individually identifiable health information through the contact form, consultation scheduler, newsletter form, or chatbot.


OmniPsych LLC is a behavioral health consulting firm and does not provide emergency, crisis, diagnostic, or treatment services through this Website. Communications through the Website are not monitored as a crisis service. If you or another person may be in immediate danger, call 911. In the United States, you may also call or text 988 to reach the Suicide & Crisis Lifeline.


This Privacy Policy is not a HIPAA Notice of Privacy Practices. If OmniPsych processes PHI on behalf of a consulting client under a written business associate agreement, that information is handled under the applicable agreement, HIPAA where applicable, and the client's policies—not through the public Website features described in this Policy. 

Data Retention

 We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including responding to inquiries, administering consultations and subscriptions, maintaining business and legal records, resolving disputes, enforcing agreements, ensuring security, and complying with legal obligations. Retention periods vary based on the type and sensitivity of information, the nature of our relationship with you, applicable limitation periods, and legal, accounting, regulatory, and operational requirements. We may retain deidentified or aggregated information that cannot reasonably identify you. 

Data Security

 We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. However, no Internet transmission, electronic storage system, or security method is completely secure. We therefore cannot guarantee absolute security. You are responsible for using caution when deciding what information to transmit online and for avoiding the submission of sensitive information through public Website features. 

Your Choices

 Email communications: Use the unsubscribe link in a newsletter or email lisa@omnipsych.org.

Cookies: Adjust browser controls to block, delete, or limit cookies, recognizing that some Website features may be affected.


Information updates: Contact us to request correction of contact information you previously submitted.


Chatbot: Do not use the chatbot if you do not want the message content processed by the chatbot provider and OmniPsych.

U.S. State Privacy Rights

 Depending on your state of residence and whether a particular state privacy law applies to OmniPsych or the relevant processing, you may have rights concerning your personal information. These may include the right to:

  • Confirm whether we process your personal information and access or obtain a copy of it;
  • Request correction of inaccurate personal information;
  • Request deletion of certain personal information;
  • Obtain a portable copy of certain information you provided;
  • Opt out of the sale of personal information, targeted advertising, or certain profiling;
  • Limit or withdraw consent for certain processing of sensitive personal information, where applicable;
  • Appeal our decision concerning a privacy request, where applicable; and
  • Receive equal service and not be discriminated against for exercising an applicable privacy right.


OmniPsych does not currently sell personal information, share it for cross-context behavioral advertising, or use it for targeted advertising. Some rights apply only when statutory thresholds and other requirements are met, and legal exceptions may permit or require us to retain or decline to act on certain information.

Submitting a Privacy Request

 To submit a request, email lisa@omnipsych.org with the subject line 'Privacy Request' or write to the mailing address in Section 20. Please describe your request and identify your state of residence. We may ask for information reasonably necessary to verify your identity and authority. We will use verification information only for that purpose. If we cannot verify a request, we may be unable to fulfill it.


Where permitted, an authorized agent may submit a request on your behalf. We may require proof of authorization and may ask you to verify your identity directly. We will respond within the period required by applicable law. If we deny a request, our response will explain the basis for the decision and any available appeal process.

Nevada Privacy Rights

 Nevada residents may submit a verified request directing us not to make a 'sale' of covered information, as those terms are defined by Nevada law. OmniPsych does not currently sell covered information. Nevada residents may nevertheless submit a request by emailing lisa@omnipsych.org with the subject line 'Nevada Privacy Request.' This Policy also describes the categories of covered information we collect, the categories of third parties with whom information may be shared, how consumers may review or request changes to covered information, how we notify users of material changes to this Policy, and whether third parties may collect information about online activities over time. 

California Privacy Information

 

If the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the 'CCPA'), applies to OmniPsych's processing of your personal information, California residents may exercise the applicable rights described in Section 12. For CCPA purposes, the categories we may collect include identifiers, Internet or other electronic network activity, professional or employment-related information that you voluntarily submit, and inferences drawn from Website interactions for basic business and Website-improvement purposes. We collect these categories from you, your device, service providers, and permitted public or referral sources; use them for the purposes in Section 3; and may disclose them to the recipients described in Section 7 for business purposes.


OmniPsych does not sell personal information or share it for cross-context behavioral advertising and has not knowingly done so during the preceding 12 months. OmniPsych does not knowingly sell or share personal information of consumers under 16 years of age. We do not use or disclose sensitive personal information for purposes that require a right to limit under the CCPA. California's 'Shine the Light' law may allow certain residents to request information about disclosures for third parties' own direct-marketing purposes; OmniPsych does not make such disclosures.

Children Privacy

 The Website is intended for business and professional audiences and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has submitted personal information to us, contact lisa@omnipsych.org so we can review and, where appropriate, delete it. 

Third-Party Websites and Services

 The Website may contain links to or integrations with third-party websites and services. Those parties operate independently and their privacy practices are governed by their own notices. OmniPsych is not responsible for the privacy, security, content, or practices of third parties. We encourage you to review their policies before providing information. 

Deidentified and Aggregated Information

 We may create and use information that has been aggregated or deidentified so that it cannot reasonably be linked to you. We may use and disclose that information for lawful business purposes, including analytics, service improvement, research, reporting, and security. Where required by law, we will maintain deidentified information in deidentified form and will not attempt to reidentify it except to test whether our deidentification processes are effective or as otherwise permitted by law.  

Changes to this Privacy Policy

 We may update this Policy from time to time to reflect changes in our practices, Website features, service providers, or legal requirements. We will post the revised Policy on the Website and update the 'Last Updated' date. If changes are material, we may provide additional notice as required by law. Your continued use of the Website after an updated Policy becomes effective signifies your acknowledgment of the revised Policy. 

No Professional or Confidential Relationship Through the Website

 Submitting information through the Website, scheduling a consultation, subscribing to a newsletter, or using the chatbot does not create a consultant-client, attorney-client, provider-patient, fiduciary, or other professional relationship. Website communications should not be treated as confidential unless and until OmniPsych confirms otherwise in a separate written agreement. Do not submit trade secrets, privileged material, patient information, or other confidential information through public Website features.
